1. Introduction

Welcome to Moments by QR (“we”, “us”, “our”). By accessing or using our website at momentsbyqr.com, our mobile application, or purchasing any of our products or services, you (“you”, “the user”) agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

If you do not agree with any part of these Terms, you must not use our platform or services.

2. About the Service

Moments by QR is a digital memorial platform designed to help Muslim families create, preserve, and share lasting tributes to their loved ones who have passed. Our service consists of two core components:

Physical Products — QR-engraved steel plaques, keyrings, memorial hearts, cards, and other keepsakes, purchased through our online shop.

Digital Platform — A secure, private memorial space accessible via the QR code linked to your purchased product. The platform is accessible through our web application and our dedicated iOS and Android app.

3. Eligibility

You must be at least 18 years of age to purchase our products or create a memorial. By using our services, you confirm that you are 18 or older or are acting under the supervision of a parent or legal guardian who has agreed to these Terms on your behalf.

4. Account Registration

To access the digital memorial platform, you must create an account. You agree to:

  • Provide accurate, complete, and up-to-date registration information.
  • Keep your login credentials confidential and not share them with unauthorised individuals.
  • Notify us immediately at helpdesk@momentsbyqr.com if you suspect any unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts found to be providing false information or violating these Terms.

5. Products and Orders

5.1 Physical Products

All physical products are made to order. Once an order is placed and confirmed, production begins promptly. Please review your order carefully before submission, as personalised items cannot be changed once production has commenced.

5.2 Pricing

All prices are listed in British Pounds (£) and include applicable VAT unless stated otherwise. We reserve the right to update pricing at any time. The price shown at the time of your order confirmation is the price you will be charged.

5.3 Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to decline or cancel any order at our sole discretion, including in cases of pricing errors or stock unavailability. You will be notified and any payment taken will be refunded in full.

6. Payment

We accept payment via Stripe. By making a purchase, you authorise us to charge your selected payment method for the total order amount.

Payment information is processed securely by our third-party payment providers. We do not store your full card details on our servers.

If a payment is declined or fails, your order will not be processed until payment is successfully received.

7. Delivery

7.1 Shipping

Physical products will be dispatched to the delivery address provided at checkout. We are not responsible for delays caused by incorrect addresses, customs, or third-party courier services.

7.2 Delivery Times

Estimated delivery timeframes will be provided at checkout and are indicative only. We will endeavour to meet these but do not guarantee them.

7.3 Risk of Loss

Risk of loss or damage to physical products passes to you upon delivery to the specified address.

8. Returns and Refunds

Because our products are personalised and made to order, we are unable to accept returns or offer refunds unless the item arrives damaged or defective.

If your order arrives damaged, please contact us within 7 days of delivery at helpdesk@momentsbyqr.com with photographs of the damage, and we will arrange a replacement or refund at our discretion.

Digital access (the memorial platform) is non-refundable once your QR code has been activated and the memorial has been created.

9. Digital Memorial Platform

9.1 Lifetime Access

Your one-off purchase provides lifetime access to the digital memorial platform for the specific memorial associated with your QR code. No recurring subscription is required for standard use.

9.2 Optional Storage Upgrades

Additional storage capacity may be purchased separately if required. These upgrade purchases are also non-refundable once applied to your account.

9.3 Access Control

You have full control over who can view your memorial. You may configure your memorial as:

  • Private — accessible only by those with a PIN or password.
  • Public — viewable by anyone who scans the QR code.
  • Role-based — managed via admin and viewer access roles within the app.

You are solely responsible for managing access permissions to your memorial.

9.4 Content Uploaded to Memorials

You retain ownership of all content (photos, videos, biographical information, tributes) that you upload to the platform. By uploading content, you grant us a non-exclusive, royalty-free licence to store, display, and deliver that content solely for the purpose of operating your memorial.

You warrant that all content you upload:

  • Is owned by you or you have the right to share it.
  • Does not infringe the intellectual property, privacy, or any other rights of a third party.
  • Is not unlawful, offensive, defamatory, or contrary to Islamic values of dignity and respect.

We reserve the right to remove content that violates these Terms without prior notice.

9.5 Notifications

You may receive real-time notifications when tributes, comments, or memories are added to a memorial you manage. You can manage notification preferences within the app settings.

10. Acceptable Use

You agree not to use the platform to:

  • Upload or share content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with a person.
  • Attempt to gain unauthorised access to another user’s memorial or account.
  • Interfere with or disrupt the operation of our services, servers, or networks.
  • Use the platform for any commercial purpose without our prior written consent.
  • Attempt to reverse-engineer, decompile, or extract source code from our application.

Violation of these terms may result in immediate suspension or termination of your account without refund.

11. Intellectual Property

All content on the Moments by QR website and application — including but not limited to text, graphics, logos, icons, images, and software — is the property of Moments by QR and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

12. Sensitive Nature of Service

We recognise that our service involves the memories of deceased individuals and is deeply personal. We are committed to treating all memorial content with the utmost dignity, respect, and care consistent with Islamic and broader ethical values.

We ask all users to approach the platform with the same sensitivity.

13. Service Availability

We aim to keep the platform available at all times, but we do not guarantee uninterrupted access. We may carry out maintenance, updates, or improvements that temporarily affect availability. We will endeavour to provide notice of planned downtime where possible.

We are not liable for any loss or inconvenience caused by temporary unavailability of the service.

14. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
  • Our total liability to you for any claim arising from these Terms or the use of our service shall not exceed the amount you paid for the specific product or service giving rise to the claim.
  • We are not responsible for content uploaded by users, or for any loss of memorial data caused by user error.

Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

15. Third-Party Services

Our platform integrates with third-party services including payment processors (Stripe, PayPal) and hosting providers. These services have their own terms and privacy policies, which you should review independently. We are not responsible for the practices of any third-party services.

16. Termination

We reserve the right to suspend or terminate your access to the platform if you breach these Terms. Upon termination, your right to access the memorial platform will cease. Any content you have uploaded may be retained for a period after termination in accordance with our Privacy Policy before being securely deleted.

17. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the website or app, and the “Last Updated” date at the top of this page will be revised accordingly. Your continued use of the service after any changes constitutes your acceptance of the updated Terms.
